Trident FC have been ordered to pay K1.4 Million to their former head coach Albert Kachinga and his assistant coach Joseph Musonda. Kachinga and Musonda will get around K778,000 and K595,000 respectively for the termination of their contracts ‘without just cause’. This is according to the FAZ Players Status Committee ruling made available to the ZamFoot Crew. 👉The Football Association of Zambia (FAZ) Players Status Committee has ruled in favour of former Trident FC head coach Albert Kachinga and assistant coach Joseph Musonda, ordering the Total pay to the duo K1,375,750. Breakdown of Payments: 👉- Head Coach Albert Kachinga: K778,750 👉- Assistant Coach Joseph Musonda: K595,000 Background: The FAZ Players Status Committee found Trident FC liable for terminating the contracts of Kachinga and Musonda without just cause. BELOW IS A FULL STATEMENT FROM FAWUZ ON THE MATTER Trident FC Ordered to Pay Former Coaches Albert Kachinga and Joseph Musonda K1.4 Million TRIDENT FC will pay a total of almost K1.4 million to the former head coach and his assistant after being found guilty of wrongful termination of contracts by the FAZ Players Status and Transfer Committee (PSC). This is contained in a ruling in a case in which the Footballers and Allied Workers Union of Zambia (FAWUZ) successfully represented Coach Albert Kachinga and his assistant Joseph Musonda after Trident FC contracts terminated “without just cause”. Facts before the FAZ PSC were that Kachinga had signed a 1 year and nine months on 5th October, 2023 which was due to run until 30 July 2025. However, Trident FC terminated the contract on 11th March, 2024 over alleged poor performance and further refused to pay the affected coaches their dues for the remainder of their contract terms and as such filed a case before the FAZ PSC through FAWUZ. In their ruling of 5th September, 2024, the PSC found that Trident FC’s decision to terminate the duo’s contracts was without Just Cause. “It was agreed that the termination of the contract of the Complainant as a coach did not fall within the realm of Just Cause as stipulated under the Rules for the employment of Coaches as contained in Annex 8 of the FIFA Regulations and Transfer of Players,” the Ruling read in part. “It was agreed that Trident Football Club was in breach of Clause 3 of the aforesaid Annex which provides as follows: A contract may only be terminated upon expiry of its term or by mutual agreement.” The Committee established that Trident FC terminated the contract “Without Just Cause” and the Complainant had not signed any other contract with any club since the termination. It was decided that the club compensates the Complainant pursuant to clause 6 (a)of Annex B aforementioned that stated that in the event that the coach did not sign any new contract following the termination of their previous contract, as a general rule, the compensation shall be equal to the residual value of the contract that was prematurely terminated. “It is therefore decided that the Respondent (Trident FC) shall compensate the Complainant the total sum of K595,000 only for the period of 17 months which is equal to the residual value of the Contract that was prematurely terminated. It was decided that the Respondent shall be paid K183,750 as anticipated 25 per cent annual gratuity,” the FAZ PSTC ruled, with the total payment for Kachinga being K778,7750. Musonda was also awarded a total of K595,000 broken down into K448,000 for a period of 17 months equal to the residual on the contract and K147,000 as anticipated 25 per cent annual gratuity in the same case. Welcoming the ruling, FAWUZ General Secretary Joe Kaunda said the Union was elated with the positive judgment that confirmed the commitment towards serving its membership in seeking justice. “Many a time, our members have just walked away from injustice after unjustified dismissals. But I want to urge them to seek justice through the Union as we will fight for them to get their money and whatever dues they are owed,” Kaunda said. “We also want to urge the club administrators to understand the FIFA statutes and regulations so that they make sound and informed decisions in cases of separation and termination of contracts because clubs may suffer serious sanctions from both FAZ and also FIFA for such avoidable breaches.” And in a related matter, FAWUZ has appealed an earlier ruling on 1st November, 2024 by the FAZ PSTC against Donewell Yobe whose contract was terminated based on poor performance which included maintaining his then Solwezi based team in the premier league. “We find it rather shocking that the PSTC ruled against Yobe and their justification to do so. The Kachinga and Musonda Vs Trident case is an identical case as the Yobe Vs Kansanshi Dynamos FC where FIFA does guide that you can only terminate a coach’s contract upon expiry of term or mutual separation and not based on performance,” said Kaunda. “We will ensure that we fight it until justice is served.”
ZESCO United interim gaffer Emmanuel Siwale was left frustrated after a ‘painful’ loss to Power Dynamos on Wednesday afternoon at Arthur Davies Stadium in a rescheduled week 5 MTN Super League encounter. Moses Shumah scored the only goal of the game in the eighth minute to hand ZESCO United their third straight loss in the Super League. Siwale after the match said the loss was painful and it was frustrating that his side failed to hit the back of the net even once throughout the 90 minutes. Zega Mambo last won a game in the league on 5th October, 5-0 over struggling Mines United at Levy Mwanawasa Stadium. “It’s very frustrating, especially where we didn’t put at least one in the net, but this is a painful loss,” he said. “It’s only that we haven’t gotten a win ever since we qualified to the Group stage. Sometimes this is what you expect because the boys put in all in the calf, forgetting that this is what made us to play the calf. So, as soon as they realise this, then I’m sure we’ll be good to go.” Siwale however picked positives from a very improved performance in the second half. “Yeah, especially the second half because we saw what Power Dynamos were doing and we now had to make changes, I’m sure you saw, and this is where we had to, even if we had the chance, I don’t know if I would say luck or what, maybe this is where we would have gotten at least a goal because of the pressure that we put on our colleagues. But the second half was exciting, especially that we are both in the CAF ( Champions League and Confederation Cup) to see where we are, but it’s bad for us because we did not win the game, we lost,” he said. “It’s what I’m sure they’ve realised. Even when they saw the fixture, you could see the second half where everyone wanted to win or to get a positive result. That is the character that we want, the second half. I’m sure going forward, if we can pick it up from the second half, I’m sure we’ll start posting a positive result. “No that went because of how the game went. That’s how you sometimes strategize because you have to see what your opponent are doing and then you work on their weakness. So we saw what they were doing and we had to change. We didn’t want to do it there and then. We were waiting for the second half and that’s how you saw us do what we did.” “It says in terms of what your colleague has just asked me because we saw what they were doing and then we capitalized on that and you could see our colleagues now also trying to counter what we did. But we had already gotten the momentum. What was remaining was a goal. But credit to them because they won the game,” he added. The Zega Mambo gaffer is worried because his side wants to defend the ABSA Cup but at they are outside the qualification bracket. “Yeah, it is. It is worrying because that is not where we belong. We have to defend the ABSA, but if we can’t win, how are we going to defend it? Because at the moment, that is one of our targets, the ABSA Cup, because we want it. And if we cannot pull away from the bottom there, it’s not going to be good for the team like ZESCO United.” “What I would say, yes, that’s a very good question because ZESCO is, I would say, a work in progress. You have seen the young ones and I’m happy that we have been put in that draw, especially for CAF. Because this is where we belong and even the boys, they must make sure they experience that. And I’m sure if we can continue playing in CAF, I’m seeing light at the end of the tunnel. Because these boys, once they get the experience, they mature, then Zesko will move to another level.” ZESCO United have now lost their last three matches in the MTN Super League and sit 12th on the log table with 10 points from eight games.
By Precious Bwale Power Dynamos take on Zesco United this afternoon at Arthur Davies Stadium in a rescheduled Week 6 encounter, a match that promises to be a mouth-watering encounter. Power heads into this match with confidence, coming off two straight victories, while Zesco United are coming from back to back losses and will be desperate to bounce back. Zesco United currently sit 12th on 10 points, while Power Dynamos are 10th on 14 points and both sides still have three games in hand. Head coach Oswald Mutapa acknowledges the challenge ahead and admits there is no more easy games. “Another tough game coming on Wednesday. There are no easy games anymore. We are just from playing Nkwazi. It was a tough game but for me it’s the mentality we are taking into this one,” he said. Mutapa emphasised the importance of staying alert despite their run of form. “We are coming from two wins, Zesco is coming from two consecutive losses, and that’s where we need to be wary of. We need to fight, show character and personality because we need the three points.” On the other side, Zesco United interim coach Siwale believes this fixture will bring both quality and tactical discipline and are eager to break the negative streak. “It will be an interesting and tactical battle, where everyone will try to put up something, it will be like playing chess.” “We want to reverse the situation which we have found ourselves in, in the past two games and we want to end the trend.” Mutapa also pointed out that the ABSA Cup remains a key target for Power Dynamos. “We need to play ABSA and that can only happen depending on the points we accumulate by the end of the first round. So it’s important we get the results, especially at home, riding on the two wins we have recorded.” With domestic league duties, continental commitments and ABSA ambitions all on the agenda, Mutapa says the players understand the task ahead. “Dominance is key for us to go very far, but it will require a lot of hard work, character and personality.” “It’s important that we start recording wins slowly but surely. These games in hand need to be taken with the seriousness they deserve,” he added. Kick off at Arthur Davies Stadium at 15h00 with tickets for open wing going at K30 and VIP at K300.
